The rules for playing Wizardly Way and using this website.
1. Agreement
These Terms of Service ("Terms") are an agreement between you and Sean Murray, the developer and operator of Wizardly Way ("Wizardly Way", "we", "us"). They cover the Wizardly Way mobile game (the "Game"), our game servers and this website (together, the "Services").
By creating an account, downloading or playing the Game, or using the website, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
2. Eligibility
You must be at least 13 years old, or the minimum age required to use online services without parental consent where you live if that is higher. If you are under 18 (or the age of majority where you live), you confirm that a parent or legal guardian has reviewed and agreed to these Terms, including for any purchases.
3. Your account
- Give accurate information when you register and keep your email address current.
- Keep your password private. You are responsible for activity on your account.
- One person per account. Don't sell, trade, share or transfer accounts.
- Choose a character name that isn't offensive, misleading, or someone else's real name, trademark or personal information. We may change or remove names that break these rules.
- Tell us right away at sean@wizardlyway.com if you think your account has been compromised.
4. Play safely
Wizardly Way uses your real-world location. You are responsible for your own safety and for following the law while you play.
- Stay aware of your surroundings. Don't play while driving, cycling, crossing streets or doing anything that needs your full attention.
- Don't trespass or enter private property, restricted areas or unsafe places. A portal, enemy or building appearing somewhere in the Game is not permission to go there.
- Respect other people, local rules and opening hours of public places.
- Think before placing a building at your real home or another sensitive location, since its position is saved and may be visible to other players.
- Be careful about meeting people you know only from the Game.
5. Development and test versions
Wizardly Way is under active development. Alpha, beta and other test versions may contain bugs, may be unavailable at times, and may change significantly. We may reset, rebalance or remove characters, progress, items and currency during development, including before a full launch. Where items purchased with real money are affected, we will try to restore or compensate them where reasonably possible.
6. License to play
Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game and use the Services for your own non-commercial entertainment. You may not copy, modify, distribute, sell or rent the Game, or reverse engineer, decompile or extract its source code or assets, except where the law expressly allows it.
7. Virtual items and purchases
- The Game may let you earn or buy virtual items, such as gold, spell colors and consumables ("Virtual Items"). Virtual Items are licensed to you, not sold. You don't own them, and they have no real-world monetary value.
- Virtual Items can't be redeemed for cash or anything outside the Game, and can't be transferred, sold or traded except where the Game specifically allows it inside the Game.
- Purchases are processed by Google Play under Google's terms. Prices are shown in the store before you buy.
- Except where required by law, all purchases are final. Refund requests go through Google Play under its refund policy. If a purchase didn't arrive, contact us and we'll help.
- We may change, rebalance or stop offering Virtual Items. If we shut down the Game, we'll give reasonable advance notice in the Game or on this website.
- Under-18 players need a parent or guardian's permission before making purchases.
8. Player conduct
Keep Wizardly Way fun and fair. You agree not to:
- cheat, including by faking or spoofing your GPS location, using bots, macros, mods or third-party tools that give you an unfair advantage;
- exploit bugs or glitches instead of reporting them;
- interfere with, overload, scrape or attack our servers or APIs, or try to access other players' accounts or data;
- harass, threaten, bully or impersonate others, or use hateful, sexual or illegal names or content;
- use the Game to stalk, track or locate other people in the real world;
- sell, buy or trade accounts or Virtual Items for real money outside the Game; or
- break any law while using the Services.
9. Moot Stones
Players at level 5 and above can propose a real-world spot as a Moot Stone. By submitting one, you agree that:
- The spot follows the Moot Stone guidelines: it is a public, safe place that anyone can visit, and not a private home, private property without public access, a school, a playground, or a restricted or dangerous area.
- You took the photo yourself, at that spot, and it doesn't show people's faces, license plates, or anything private or offensive.
- The name and lore line are your own words and follow the same rules as character names.
- You give us a worldwide, royalty-free, perpetual license to store, edit (for example, resizing or correcting the name), display and share your photo, name and lore line in the Game, on this website and in promotion of Wizardly Way. We'll credit you as the founder by character name.
- We may approve, edit, reject or later remove any submission at our discretion, including after reports from other players. The Mana Petals spent to submit are not refunded, including when a submission is rejected.
- An approved Moot Stone is a spot in the Game, not permission to enter any place. Always follow local laws and the rules in Play safely.
If a Moot Stone shows your property or your image and you want it removed, email sean@wizardlyway.com, even if you don't play.
10. Your content and feedback
You keep ownership of anything you create or submit, such as character names, Moot Stone photos or ideas you send us. You give us a worldwide, royalty-free license to use it to operate, display and improve the Services. If you send us feedback or suggestions (for example, dungeon ideas), we may use them freely without paying you or giving credit, though we'll try to thank you.
11. Our content
The Game, the Wizardly Way name and logo, the world of Talamh, and all artwork, code, music, text and other content in the Services belong to us or our licensors and are protected by intellectual property laws. Fan art and fan content are welcome for non-commercial use. Please don't imply it's official. If you believe something in the Services infringes your copyright, email us with details of the work, where it appears and your contact information.
12. Third-party services
The Services rely on third parties such as Google Play, Unity, Mapbox, Patreon, Bluesky and MailerLite. Their own terms and privacy policies apply when you use them, and we aren't responsible for their services. Map data may be inaccurate or out of date.
13. Suspension and termination
You can stop playing and delete your account at any time. We may suspend or end your access, or remove Virtual Items, if you break these Terms, create risk or legal exposure for us or other players, or if we stop offering the Game. Where reasonable, we'll tell you why. Sections that by their nature should survive termination (such as Virtual Items, our content, disclaimers, limitation of liability and governing law) will continue to apply.
14. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Services will be uninterrupted, error-free, secure or that your progress will never be lost.
15. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress or Virtual Items, or for personal injury or property damage arising from where or how you play. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some places don't allow these limits, so they may not apply to you, and nothing in these Terms limits rights you have under consumer protection law that can't be waived.
16. Indemnity
If you break these Terms or the law while using the Services and someone brings a claim against us because of it, you agree to cover our reasonable losses and costs, to the extent the law allows.
17. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which Wizardly Way's operator resides, without regard to conflict-of-law rules. Before filing any claim, please contact us so we can try to resolve it informally. If you live in the European Union, the United Kingdom or another country with mandatory consumer protections, you also keep the protection of the laws of your country and may bring claims in your local courts.
18. Changes to these terms
We may update these Terms as the Game evolves. We'll post the new version here and update the date at the top. For significant changes we'll give notice in the Game or by email before they take effect. If you keep using the Services after the changes take effect, you accept the updated Terms.
